The U.S. Supreme Court last week further tightened the use of race in making
hiring and promotion decisions. In the New Haven, CT, fire department case,
the court ruled that an employer cannot throw out the results of a
non-discriminatory test – resulting in discriminating against non-minority
high scorers – to avoid charges of discriminating against minority
